Terms of Service
Last updated: November 5, 2026
These terms are an agreement between FAXcrm LLC ("we") and the business that subscribes to FAXcrm ("Customer"). By creating an account, the Customer agrees to them.
1. The service
FAXcrm is a web portal for sending funding offers to merchants from the Customer's own Gmail, tracking responses, collecting statements and applications, and managing deals. Each Customer gets its own private copy of the portal.
2. Plans and billing
| Item | Price |
|---|---|
| Plan (includes 1 user and every feature) | $349 per month |
| Each extra user | $50 per month |
- Billed monthly in advance through Stripe, starting on the signup date (after any free trial).
- Users can be added or removed at any time from Billing; changes are prorated by Stripe.
- Prices do not include sales tax; we add it where the law requires.
- We may change prices with at least 30 days' email notice; the new price applies from the next billing period.
3. Cancellation and non-payment
- The Customer may cancel at any time from Billing. The portal stays available until the end of the paid period. Payments are not refunded except where law requires.
- If a payment fails, Stripe retries it and the portal keeps working meanwhile. If the subscription ends unpaid, the portal is locked until billing is updated.
- After cancellation, data is kept for 30 days for export, then permanently deleted (see the Privacy Policy).
4. Accounts and users
- The Customer is responsible for its users, keeping passwords private, and everything done in its account.
- Each user connects their own Gmail account. The Customer must have the right to use each connected mailbox.
5. The Customer's data and compliance
- The Customer owns the data it and its merchants put into the portal and grants us only the rights needed to run the service.
- The Customer is responsible for having a lawful basis to contact each merchant and to collect their information, including bank statements, Social Security numbers and other sensitive data.
- The Customer is responsible for complying with laws that apply to its business, including the CAN-SPAM Act, the Telephone Consumer Protection Act, the Gramm-Leach-Bliley Act where it applies, and state commercial financing disclosure laws (for example in New York and California).
- Offers, rates and terms shown in the portal are set by the Customer. We are not a lender or broker and do not review or approve any offer.
6. Data protection
For the data a Customer and its merchants put into the portal, we act only as the Customer's service provider:
- We use it only to run the service for that Customer, never for our own purposes, and never sell it.
- Everyone with access to it is bound to keep it confidential, and access is limited to what running the service needs.
- We keep administrative, technical and physical safeguards suited to sensitive financial information (including Social Security numbers and bank statements), designed with the FTC Safeguards Rule in mind: a separate database for each Customer, encrypted connections, hashed passwords and restricted access.
- Our service providers are listed in the Privacy Policy. We will update that list before adding a new one that handles Customer data.
- If a breach affects the Customer's data, we notify the Customer within 72 hours of confirming it and help them meet their own notice duties.
- The Customer can export its data at any time (Settings → Your data). It is permanently deleted 30 days after the subscription ends, or sooner on request.
7. Acceptable use
The Customer may not use FAXcrm to:
- send spam or email people who have unsubscribed (the portal adds an unsubscribe link and stops emailing anyone who uses it);
- send misleading offers or impersonate another business;
- upload malware, break into other accounts, or overload the service;
- resell or copy the portal, or reverse engineer it.
We may suspend an account that breaks these rules or puts the service or Gmail sending at risk.
8. Third-party services
The portal works with Google (Gmail), Stripe, Render and the Customer's chosen form provider. Their own terms apply to them, and we are not responsible for their outages or changes.
9. Availability and changes
We work to keep the service available but do not guarantee it will be uninterrupted. We may improve or change features; we will give notice before removing a major feature.
10. Disclaimers and limit of liability
- The service is provided "as is", without warranties of any kind, to the extent the law allows.
- We are not liable for lost profits, lost deals, or indirect or consequential damages.
- Our total liability for any claim is limited to the amount the Customer paid us in the 12 months before the claim.
11. Indemnity
The Customer will defend us against claims that arise from its data, its emails to merchants, its offers, or its breach of these terms.
12. Governing law
These terms are governed by the laws of New York. Disputes go to the state or federal courts in Kings County, New York.
